Adoption of a foreign child - apply for notarisation

    Would you like to adopt a child from abroad? Then you should clarify the recognition of such an adoption in Germany in advance. After the adoption abroad, the foreign birth certificate of your adopted child remains valid. As the adoptive parents, you can still apply for the birth to be notarised in Germany.

    Note: If a German court decides on an adoption, it will also carry out the notarisation. The same applies if a German family court converts a foreign adoption from a weak to a strong adoption.
     

  • Procedure

    You must apply for the birth of your child born abroad to be notarised at the registry office of your place of residence. Here you can also apply for a new birth certificate.

    The registry office will enter the change in the civil status register.

    Note: The registry office that notarises the birth of your child born abroad will automatically inform other registry offices.

    Note: You need foreign documents with over-certification by the competent foreign authority (apostille) or legalisation by the German diplomatic mission abroad.
     

  • What fees are incurred?

    Notarisation is free of charge. A fee is charged for the issue of a birth certificate.

  • Legal remedy

    If you do not agree with a decision made by the registry office, you can appeal to the local court. (§ 49 Para. 1; § 50 Personal Status Act). The local courts that have their seat at the location of a district court are exclusively responsible for the decisions.
