Service description
There is a closing time for restaurants and events in Hesse. Closing times are the legally regulated periods during which pubs, bars, restaurants, discos, beer gardens, etc. are closed. The main purpose of the closing time is to protect against noise. Operations must cease at this time.
In principle, the following regulations apply in Hesse:- The general closing time for the catering industry and for public entertainment venues (places where, for example, theatre and film performances or dance events take place) begins at 05:00 and ends at 06:00.
- The closing time for public entertainment venues in amusement parks, at trade fairs, fairgrounds, funfairs and fairgrounds as well as for the catering trade that is operated in connection with these events or venues begins at midnight and ends at 06:00.
- The closing time for other public entertainment venues where events are held in accordance with Section 60a of the Trade, Commerce and Industry Regulation Act, e.g. the installation of gaming machines, begins at midnight and ends at 6am.
The curfew is lifted on the night of 1 January, on the nights of the Friday before Shrove Tuesday until Ash Wednesday and on the night of 1 May.
Exceptions to this are possible.
If there is a public need or special local circumstances, you can have the closing time generally extended for all businesses at municipal, district or administrative district level or for certain events and individual businesses on application.
- Please note: The 4:00 - 10:00 a.m. closing time regulations generally apply to gaming arcades, regardless of whether the devices installed in them offer the opportunity to win. The more extensive regulations for public holidays must be observed. The provisions of the legal basis also apply exclusively to possible exceptions.
Procedure
If you want to apply for an extension of the blocking period, then
- submit an application for an extension of the blocking period online or in writing to the competent authority as early as possible.
- explain in detail why you see a "public need" or special local circumstances for extending the closing time. This is often justified by the event that you want to continue.
- You will receive an authorisation or a notification of rejection of the application.
Responsible office
The cities and municipalities are responsible, and the magistrate or municipal council is responsible for amusement arcades.
Prerequisites
You must demonstrate the existence of a public need or special local circumstances. An extension of the curfew would therefore have to be in the public interest, which corresponds to the "public need" for your application. This interest must be explained in detail in the application.
