    When the election is over, the electoral and postal ballot boards determine how many votes the respective list ballot proposal has received for their respective electoral and postal ballot districts. The district or city electoral committees then determine how many votes the respective list nominations received within the respective district or city. These election committees can also correct the findings of the election committees and decide on the validity of votes cast. As the next instance, the state electoral committee determines the votes for the election proposals on a state-by-state basis. It may make arithmetical corrections to the results of the electoral boards and district and city electoral committees. Finally, the Federal Electoral Committee determines the votes cast at federal level. It also determines the number of seats for the list election proposals and determines the elected candidates. The Federal Electoral Committee may make arithmetical adjustments to the results of the Land electoral committees.

  • Procedure

    The result of the European elections is determined as follows:

    • The electoral and postal ballot boards determine the result in each electoral and postal ballot district, prepare a record and submit it to the municipal authority.
    • The municipal authority of a district municipality prepares a compilation of the results of all polling districts and postal ballot districts in the municipal area and submits it to the district returning officer.
    • The district and city electoral committees determine the result in their area of responsibility (district or independent city) and forward it to the state returning officer.
    • The Land electoral committee determines the result in the Land and forwards it to the Federal Returning Officer.
    • The Federal Electoral Committee determines the result for the federal government, how many seats are allocated to the individual parties and which candidates have been elected.
  • Prerequisites

    The prerequisite for determining the election result is the determination of the lower levels (district, state).

    • Annex 29 to the European Electoral Regulations: Minutes of the meeting of the Land Electoral Committee to determine and establish the result of the election to the European Parliament
    • Annex 30 to the European Electoral Regulations: Minutes of the meeting of the Federal Electoral Committee to determine and establish the election result in the electoral area of the election to the European Parliament
