  • Service description

    An auction must be notified at least 2 weeks before the planned auction date. In exceptional cases, particularly in the case of perishable auction goods, an application may be made to shorten the two-week notification period.

  • Which documents are required?

    The display is labelled with
     

    • Place and time of the auction and
    • Type of goods to be auctioned


    and to be made in writing.


    If the auction involves goods that are
     

    1. belong to an estate or an insolvency estate or
    2. are sold due to business closure or
    3. are sold by public auction on the basis of statutory provisions (Section 383 (3) of the German Civil Code) and
    4. are offered in open sales outlets and which are unused or whose intended use consists in their consumption,

    The written advertisement also contains
     

    • the reason for the auction and
    • the name and address of the clients


    to be indicated.
     

  • What fees are incurred?

    None for the notification.

    If the deadline for notification is shortened in accordance with Section 3 (1) sentence 2 of the Auctioneers Ordinance, fees are charged according to the time spent by the authorities.

  • What else should I know?

    No notification is required for the auctioning of agricultural inventory, agricultural and forestry products or livestock (see Section 3 (1) sentence 2 of the Auctioneers Ordinance).

    Subsequent notification of individual auctioned items is possible if the requirements of Section 3 (2a) of the Auctioneers Ordinance are met.

    A new auction may only be started at the location of the previous auction if the previous auction ended at least 5 days ago. An auction may not exceed a duration of 6 days. In individual cases, the local authority may grant exceptions to the above time limits. (see § 3 Para. 3 of the Auctioneers Ordinance)
