Obligation to wear a seatbelt and helmet - exemption

    To protect road users, the legislator has stipulated that seat belts must be worn while driving and that safety helmets must be worn when driving motorbikes.

    However, it is possible to be exempted from this obligation upon request. The resulting considerable safety risk is borne by the applicant.

    You can be exempted from the obligation to wear a seatbelt,

    • if it is not possible to wear seat belts for health reasons.
    • if the height is less than 150 cm.
    • You may be exempted from the obligation to wear a helmet,
    • if it is not possible to wear a safety helmet for health reasons.
  • Which documents are required?

    If the requirements for an exemption are of a medical nature, a medical certificate must be submitted stating that the exemption to be applied for is absolutely necessary for medical reasons. The certificate does not need to include a diagnosis.
    If you are less than 150 cm tall, you must also bring a medical certificate stating your height.

  • What fees are incurred?

    The decision can be issued free of charge; otherwise the fees range from 10.20 euros to 767.00 euros.

  • What deadlines do I have to observe?

    The exemption is revocable and generally granted for a limited period of one year, unless the medical certificate states that the state of health will no longer improve; the exemption is then granted for an unlimited period.
