    If you wish to marry abroad, the foreign state may require you to present a certificate of no impediment to marriage.

    The registry office at the place of the last habitual residence in Germany is responsible for issuing a certificate of no impediment to marriage for German nationals without a domicile or current habitual residence in Germany. If the person getting married has never stayed in Germany or has only stayed temporarily, the registry office 1 in Berlin is responsible.

  • Procedure

    An application for a certificate of no impediment to marriage is submitted to the competent registry office 1 in Berlin. If the examination shows that there is no impediment to the intended marriage under German law and the required information on the two fiancés has been provided, the registry office will issue the certificate of matrimonial capacity applied for.

    • The person must have German citizenship.
    • The intended marriage is to take place abroad
    • There must be no impediment to the intended marriage under German law
  • Which documents are required?

    • The requirements, type and format of the evidence to be provided and the examination of the marriage requirements are governed by German law.
    • Evidence must be provided in the form of public documents:
      • The civil status
      • Domicile, habitual residence
      • The nationality
      • As well as, if applicable, the last marriage(s) and/or civil partnership(s) and their dissolution(s)
  • What fees are incurred?

    If Registry Office I is responsible, fees are charged in accordance with Berlin state law. If a Hessian registry office is responsible for issuing the certificate, fees of 47.00 euros will be charged and, if foreign law is also to be taken into account, an additional 23.50 euros per right, unless the municipality has set different fees by statute.

    Once issued, the certificate of no impediment is valid for a period of six months.
